Board of Adjustment

The Board of Adjustment meets at 7 p.m. the second Wednesday of each month in the Town Barn. The Town Barn is located on the Town Hall campus at 101 E. Orange St.

The board hears, reviews, decides and issues the following permits: 

  • Conditional Use 1 and 2 Permits (including modifications to these permits)
  • Special Exception Permits
  • Change in Nonconforming Use Permits

 

The board also hears, reviews and decides the following:

 

  • Requests for variances from specific requirements of the Zoning Ordinance and the Flood Damage Prevention Ordinance
  • Appeals from enforcement actions, orders, requirements, decisions and determinations of the zoning officer and minimum housing inspector
  • Appeals from decisions of the Technical Review Committee and Historic District Commission
  • Appeals from the Planning Department’s decision regarding Subdivision Exemption Certificates
  • Interpretations of the Zoning Ordinance
  • Various other determinations specifically stated in the Zoning Ordinance, such as required number of off-street parking spaces and use of alternative screening methods  

Board of Adjustment Process Summary

 

The board is comprised of seven members: five regular members and two alternate members.

 

  • Three regular members and one alternate member are residents of the town and are appointed by the Town Board
  • Two regular members and one alternate member are residents of the town’s extraterritorial jurisdiction and are appointed by the Orange County Board of Commissioners. The ETJ is an area outside of the town’s corporate limits where the town has zoning and subdivision regulation authority.
  • One regular member also serves on the Hillsborough Planning Board and is selected by the Planning Board on an annual basis.
